Terms of Use

1. Acceptance of these terms

These Terms of Use are an agreement between you and Thoughtfully. By creating an account, filling in a Thoughtfully Profile, or otherwise using our website or mobile apps, you agree to these terms. If you don't agree, please don't use Thoughtfully.

2. Your account

You need an account to create and manage Thoughtfully Profiles. You're responsible for keeping your login details secure and for anything that happens under your account. Let us know right away at info@giftthoughtfully.com if you think someone else has access to it. You must be at least 13 years old to use Thoughtfully.

3. Membership & billing

Free plan

Thoughtfully is free to download and use, with one Thoughtfully Profile and the ability to invite one other person.

Paid memberships

For unlimited profiles, we offer the following auto-renewing subscriptions, purchased through your device's app store account:

• Monthly Membership — $2.99, billed every month until cancelled.
• Standard Membership — $29.99, billed every year until cancelled.
• Founding Member — a limited-time offer for our first 5,000 paid members. Billed at $24.00 every year until cancelled. This price is locked in for as long as you stay a member, even if our regular pricing changes.

Cancelling a Founding Membership

If you cancel, you lose your Founding Member status and your member number. If you rejoin while we still have fewer than 5,000 founding members, you will receive the next available member number. If we have already reached 5,000, you will rejoin as a Standard Member at the current Standard price.

Auto-renewal

All memberships automatically renew at the end of each billing period, at the price shown at the time of purchase, unless you cancel at least 24 hours before the current period ends. Your payment method will be charged through your app store account (Apple App Store or Google Play) within 24 hours before the end of the current period.

Managing & cancelling

You can view, manage, or cancel your membership at any time from your device's app store account settings (in the Thoughtfully app, go to Settings → Manage Subscription). If you cancel, you'll keep access to paid features until the end of the period you already paid for, and the membership will not renew after that.

Refunds

Payments are processed by Apple or Google, and refunds are handled under their own policies. We don't have the ability to issue refunds directly, but reach out to info@giftthoughtfully.com if something went wrong and we'll do what we can to help.

4. Acceptable use

When using Thoughtfully, please don't:

• Use the service for anything illegal, harmful, or abusive toward others.
• Share someone else's Thoughtfully Profile link without their permission.
• Try to access another person's account or profile without authorization.
• Interfere with or disrupt Thoughtfully's services or try to reverse-engineer them.
• Use Thoughtfully to send spam or unwanted messages to others.

We may suspend or remove access for anyone who breaks these rules.

5. Your content

Anything you add to a Thoughtfully Profile, such as important dates, interests, wishlists, or notes, remains yours. You give us permission to store and display it as needed to run the service, such as sharing it with people you invite or who invited you. See our Privacy Policy for more on how your information is used and protected.

6. Termination

You can stop using Thoughtfully and delete your account at any time from Settings in the app. We may suspend or end your access if you violate these terms. If your account is deleted, your profiles and data are removed as described in our Privacy Policy.

7. Disclaimer & limitation of liability

Thoughtfully is provided “as is.” We work hard to keep it running smoothly, but we can't guarantee it will always be available or error-free. To the extent permitted by law, Thoughtfully isn't liable for indirect or incidental damages arising from your use of the service. Nothing in these terms limits any rights you have that can't be limited under applicable law.

8. Changes to these terms

We may update these terms as Thoughtfully grows. If we make an important change, we'll update the date at the top and let you know. Continuing to use Thoughtfully after a change means you accept the updated terms.
